General terms and conditions

§ 1 Scope

These general terms and conditions (GTC) govern the contractual relationship between DecoCollection Hegyi (hereinafter “the seller”) and its customers for all purchase contracts concluded by telephone, by e-mail (including via the order form on this website), at market stalls and through direct sales.
By placing an order, the customer agrees to these GTC.

§ 2 Conclusion of contract

By placing an order, the customer submits a binding offer to conclude a contract. The purchase contract is concluded by an order confirmation by e-mail or telephone, or by delivery of the goods.

§ 3 Prices and payment

All prices are in Swiss francs (CHF).
Delivery costs CHF 12.00. Delivery within Switzerland and to Liechtenstein is free for orders of CHF 80.00 or more.
DecoCollection Hegyi is not subject to VAT; therefore no VAT is shown on the prices.

The following payment methods are accepted:

• TWINT
• Prepayment by bank transfer
• Cash
• Invoice (in exceptional cases)

§ 4 Delivery

We deliver within Switzerland and the Principality of Liechtenstein.
Delivery usually takes 2–4 working days. In the event of supply shortages, the customer will be informed immediately.
The goods can also be collected from us in Nidau (direct sales) by telephone appointment.

Transport damage must be reported immediately on receipt of the goods, with a photo, by e-mail to info@decocollection.ch.

§ 5 Retention of title

The goods delivered remain the property of the seller until paid for in full.

§ 6 Cancellation and returns

Purchases made at a market stall or through direct sales cannot be exchanged or returned, except in the case of defects.

Delivered orders may be returned within 14 days of receipt without giving reasons, provided the goods are unused and in their original packaging. The customer bears the cost of return unless the goods are defective.

The following are excluded from the right of return:

• BIO-OIL candles that have already been lit or opened

§ 7 Warranty

The statutory warranty provisions apply. Defects must be reported in writing immediately after receipt of the goods. Minor irregularities in the glass do not constitute a defect.
The stated burning time is a guide value; it depends heavily on temperature and wind.
Our grave lights are designed for BIO-OIL candle inserts. Other candles can be used, but ordinary paraffin candles burn hotter and produce a higher flame, which can damage the lid. Please bear this in mind when using third-party products. Damage caused by the use of third-party products does not constitute a defect and is excluded from the warranty.

§ 8 Candle safety instructions

• Candles must stand upright and securely.
• Keep a minimum distance from flammable materials.
• Do not lean over a burning candle with your face.
• Keep children and animals away from burning candles.
• Never leave a burning candle unattended.
• The lid becomes hot – only touch it once it has cooled down.
• DecoCollection Hegyi accepts no liability for damage caused by improper use.

§ 9 Liability

DecoCollection Hegyi is only liable for damage caused intentionally or through gross negligence. To the extent permitted by law, liability for slight negligence, for indirect and consequential damage and for loss of profit is excluded. Mandatory liability under the Swiss Product Liability Act remains reserved.

§ 10 Data protection

Personal data collected during the ordering process is used exclusively to process the purchase contract and is not passed on to third parties unless this is necessary to fulfil the contract (e.g. shipping service providers). The Swiss Data Protection Act applies.

§ 11 Applicable law and place of jurisdiction

Swiss law applies exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is the seller’s registered office, insofar as permitted by law.

These GTC are also available in German and French. In the event of any discrepancy between the language versions, the German version shall prevail.

§ 12 Final provisions

Should any provision of these GTC be wholly or partly invalid, the validity of the remaining provisions shall not be affected. The invalid provision shall be replaced by a provision that comes closest to its economic purpose.

DecoCollection Hegyi may amend these GTC at any time. The version valid at the time of the order shall apply.
